Terms and Conditions
Terms and Conditions of the members programme provided by Lauren Bannister and Jessica Bannister (hereby known as Pilates Health Project or as Pilates Health Project Members).
By agreeing to the below terms, you agree to a binding agreement between you (herein referred to as “You” or the “User”) and Lauren Bannister and Jessica Bannister / Pilates Health Project (www.pilateshealthproject.co.uk) / Pilates Health Project Members (herein collectively referred to as “PHP” “We” or “Us”), (each party collectively as “Parties”), in consideration of the mutual promises made in this document, with regards their websites and the content, classes, products and services (individually and collectively the “Services”). You agree to abide by all policies and procedures as outlined in this agreement as a condition of your participation in the members programme.
The Services are only for users 18 years of age or older.
PHP agrees to provide services of and within Pilates Health Project Members (herein referred to as “members programme” to include Pilates members and Pilates with Menopause members). You agree to abide by all the policies as outlined in this agreement as a condition of your participation in the members programme.
The Services allow you to access digital content on a monthly subscription basis. The basis on which digital content is available on the Services is indicated on the product detail page for which you may purchase the digital content. You agree to pay all fees and charges associated with your account on a timely basis.
We make no guarantees as to the resolution and quality of the digital content when streaming as the quality and speed of your stream of digital content has many different variables, including your connection speed, location, download speeds, devices, player and bandwidth. By using the Services you consent to receiving electronic communications from us, including emails about account, password, access, marketing, transactional and other information related to the Services and to your account.
Your Pilates Health Project monthly membership includes:
A playlist of Pilates / fitness / movement videos and mindfulness / relaxation sessions
Advice including and notwithstanding exercise and lifestyle / wellbeing
Advice including and notwithstanding nutritional adice and support
Guided cookery notes and recipe cards
PHP Newsletters / emails with notifications of monthly topics
Access to the PHP private, optional community group
A library covering menopause in Pilates with Menopause members
An additional playlist of Pilates / fitness / movement videos and mindfulness / relaxation sessions in Pilates with Menopause members
USER INFORMATION: If you register for the Services, you will be asked to provide certain information including your name, a valid email address and payment details. You certify that all such information is current and accurate, and will be kept up-to-date. Your privacy rights are set forth in our Privacy Policy located at Privacy Policy.
We reserve the right to offer our products to you based on the preferences that you identify in your registration and at any time thereafter, unless you opt-out.
USERNAME / PASSWORD / SECURITY: You are responsible for maintaining the confidentiality of your information as it relates to the Services, including your username and password. You are responsible for all uses of your username and password whether or not authorized by you. You agree to immediately notify us of any unauthorized use of your username and password.
PAYMENT: You understand that the programme runs as a monthly / annual subscription and you expressly agree that we are authorized to charge your selected payment plan on the designated payment method.
Payment options are monthly or annually for any of our Pilates and / or Menopause memberships (paid in GBP).
Receipts are sent once the charge is successful to the registered email account and your subscription will continue unless and until you cancel your subscription, by visiting ‘Account’ ‘Settings’ and clicking ‘delete my account’.
If a payment fails, your account will be suspended, but you can resume at anytime by making your payment. You are responsible for full payment of fees for the entire month of the members programme, regardless of whether you complete the members programme. No refunds will be issued for this members programme. You can cancel your membership anytime.
DISCLAIMERS: Lauren Bannister and Jessica Bannister recommend that you consult with your GP before beginning any training programme and should be in good physical health and be able to participate in exercise. If you’ve been told on health or medical grounds that you should not take part in physical activity and sport, then you won’t be able to join in with our classes live or on demand.
When engaging in this exercise or training programme, you agree to do so at your own risk and are voluntarily participating in these activities, and assume all risk of injury to yourself, and agree that PHP will not be held liable to any claims or causes of action, known or unknown, arising out of working with or participating in any of their material. You should understand that when participating in any exercise or exercise programme, there is the possibility of physical injury. By clicking on the link to a pre-recorded session or joining Facebook or Instagram Live or by accessing any of the classes or written information in the online library, you confirm to abide by the terms of this disclaimer and you agree that you do so at your own risk. PHP does not accept responsibility for any injury or accident incurred as a result of following the exercises or exercise programmes on our online library, social media or website. By purchasing and using any programme from PHP or participating in any of their classes in person or online, you agree to have read and understood the above disclaimers.
The information contained across our website, blogs, newsletters, emails and training programmes is for educational and informational purposes only, and is made available to you as guidance for your own use. Whilst we draw on our professional expertise and background, you acknowledge that we are supporting you in our role exclusively as an online coach only. We are not a medical or mental health practitioner and we are not promoting ourselves as this in any capacity. We serve only as a coach and guide who will help you reach your own health and fitness goals. You are acknowledging that you are participating voluntarily in using our website, blog, newsletters, emails and training programmes, and you alone are solely and personally responsible for your results.
By purchasing and using any programme, classes or material from PHP, you agree to have read and understood the above disclaimers.
Please use good judgement and common sense when taking part in any class.
Your exercise area should be a warm, free of obstacles with a flat surface to support your mat, and any equipment being used should be safe and suitable. Consider your ability, and choose the appropriate level of the exercises and rest when you need to and stay hydrated. As with any exercise programme, if at any point during the class you begin to feel faint, dizzy or have any physical discomfort, you should stop immediately and seek medical advice. It is inadvisable to do Pilates between weeks 8 to 14 of pregnancy, unless by special arrangement with PHP. It is also wise to wait six weeks after the birth before resuming exercise. PHP members is not specifically tailored for pre or post natal Pilates or specific conditions unless specified.
You agree not to rely on information on this website or within our training programme instead of seeking professional medical advice.
CONFIDENTIALITY: PHP respects The Client’s privacy and expects this is a reciprocal agreement. Any confidential information shared by any representative of PHP is confidential, proprietary, and belongs solely and exclusively to the party who discloses it. Both parties agree not to disclose, reveal or make use of any confidential information or any transactions, during discussions, coaching calls or otherwise, in any manner other than in discussion with PHP during the members programme.
Confidential information shall not include information rightfully obtained from a third party. Both parties will keep confidential information in strictest confidence and shall use the best efforts to safeguard and protect it against disclosure, misuse, espionage, loss and theft. The User agrees that if they violate this, PHP will be entitled to litigate and is at liberty to terminate all aspects of the agreement.
INTELLECTUAL PROPERTY: All rights reserved. Material given to The User in the course of your work with PHP is proprietary, copyrighted and developed specifically by PHP. The User agrees that such proprietary material is solely for The User’s own personal use (single-user license) and any disclosure to a third party is strictly prohibited. The User is not authorised to use any of PHP’s intellectual property for The User’s own business purposes. PHP’s copyrighted programme and/or course materials, shall remain the sole property of PHP and no license to sell or distribute PHP’s materials is granted or implied. By agreeing to the Terms & Conditions, The User agrees that if they violate, or display any likelihood of violating any of the agreements contained in this paragraph, PHP will be entitled to litigate and may terminate all aspects of the agreement. No part of this programme may be reproduced, transmitted or stored in any form, by any means, without the written permission of the author. All live and recorded content is the property of PHP and is not to be shared with third parties. You agree that Lauren Bannister and Jessica Bannister / Pilates Health Project (www.pilateshealthproject.co.uk) / Pilates Health Project Members own and retain all rights to the Services and that its content is solely owned and controlled by PHP and all such material are protected and copyrighted, trademarked and protected by copyright and trademark.
SOCIAL NETWORKING: Users may have the option to share the Services via Instagram, Twitter, Facebook or other social networking services. Users undertake this option at their sole responsibility, including but not limited to complying with all of the terms and conditions of the social networking services. PHP may share content you have shared in regards to the Services.
USER RESPONSIBILITY: The User accepts and agrees that they are fully responsible for their progress and results from the members programme. The Pilates Teacher will help and guide You however, participation is vital to the members programme’s success and that relies solely on The User. PHP makes no representations or guarantees verbally or in writing regarding The User’s performance. The User understands that because of the nature of the programme, the results experienced by each client may significantly vary. By agreeing to the Terms & Conditions, The User acknowledges there is no guarantee that they will reach their goals as a result of participation in the members programme.
DISPUTE: In the event that a dispute arises between the parties, the parties agree and accept that the only venue for resolving such a dispute shall be in the venue set forth herein below. The parties agree that they will not engage in any conduct or communications with a third party, public or private, designed to disparage the other, including: directly or indirectly, in any capacity, will not make, express, transmit, speak, write, verbalize or otherwise communicate in any way (or cause, further, assist, solicit, encourage, support or participate in any of the foregoing), any comment, message, information, declaration, communication or other statement of any kind, whether verbal, in writing, electronically transferred or otherwise, that might reasonably be construed to be derogatory or critical of, or negative toward, each other or any of its programmes, members, owner directors, affiliates, subsidiaries, employees or representatives.
LIMITATION OF LIABILITY: The User agrees they used PHP’s services at their own risk and that the members programme is only an educational service being provided. The User releases PHP, its officers, employers, directors, and related entities from any and all damages that may result from any claims arising from any agreements, past or present, between the parties. The User accepts any and all risks, foreseeable or unforeseeable. The User agrees that PHP will not be held liable for any damages of any kind resulting or arising from including but not limited to; direct, indirect, incidental, special, negligent, punitive, consequential, or exemplary damages happening from the use or misuse of PHP’s services or participatation in the members programme or from any actions we take or fail to take. This includes damages for errors, interuptions, delays, computer viruses, loss of data, and any other tangible or intangible losses, regardless of whether the damages are claimed under warranty or contract. Our maximum liability arising out of or in connection with your use of the services , regardless of cause, will not exceed the amount if any, paid for the services.
Users agree to defend, indemnify and hold us free from and against any loss, liability, claim, action or demand, including without limitation, reasonable legal and accounting fees, alleging or resulting from: your use of the services or any User generated content or communication, or your breach of the terms. We shall provide notice to you punctually of any such claim, suit or proceeding and shall assist you, at your expense, in defending such claim, suit or proceeding. We reserve the right to assume the exclusive defence and control of any matter subject to immediate indemnification. Use of the Services is governed by English law, and you agree to submit any claim or dispute arising in relation to, out of, or in connection with the Services to the exclusive jurisdiction of the English courts.
The User knowingly, voluntarily, and expressly, waives any claim for damages including but not limited to; injury or death that The User may sustain as a result of participating in this members programme. The User further declares and represents that no promise, inducement or agreement not herein expressed has been made to The User to enter into this release. The release made pursuant to this paragraph shall bind The User’s heirs, executors, personal representatives, successors, assigns, and agents.
TERMINATION: By agreeing to the Terms & Conditions, The User agrees that PHP may, at its sole discretion, terminate this agreement, and limit, suspend, or terminate The User’s participation in the members programme without refund or forgiveness of monthly payments if The User becomes disruptive as determined by PHP, or upon violation of the terms. The obligations of the participant under this agreement shall remain in effect in perpetuity after expiration or termination of this agreement. The User will still be liable to pay the total contract amount.
These Terms and Conditions govern your use of our Services, including all functionalities, features, streaming content, audio, visual, written media, PDF, website links and user interfaces, and all content and software associated with the Services as provided by us.
These Terms, including all documents referenced herein, represent the entire understanding between us and you regarding your use of the Services and supersede any prior statements or representations.
We may update these Terms from time to time and if you are a registered user of our Services, we will attempt to inform you of any material changes by email. Otherwise, please check back frequently on this page for any changes as those will apply to you from the time these are updated.
I have caused this agreement to be executed and delivered as of the date first written (12 April 2022).
As the User: I have read and agree to the working agreements above, and will honour them during our coaching relationship.
